When community life breaks down

Years unresolved, not because there's no solution, but because nobody built the conditions for one

Living in a Spanish urbanisation can be enormously rewarding. It can also become a source of sustained conflict that affects daily life, property values and mental wellbeing.

Disputes with community presidents, disagreements over gestoría decisions, shared facility conflicts, noise complaints, unauthorised works and unpaid community fees escalate quickly, and are poorly served by the formal routes available under Spanish property law.

Going to court in Spain is slow, expensive and uncertain. Many disputes sit for years.

What I work with

Four kinds of community dispute

Sessions are conducted in English and Spanish.

President and resident conflicts

Where decisions are perceived as arbitrary, unfair or discriminatory, or where communication has broken down entirely.

Gestoría and management disputes

Where residents feel community funds, decisions or administration are not being handled transparently or fairly.

Neighbour conflicts

Noise, boundaries, shared spaces, pets, parking, and the daily friction of communal living.

Unpaid fees and shared costs

Reaching workable agreements without escalating to proceedings under the Ley de Propiedad Horizontal.

Why this approach is different

Community disputes in Spanish urbanisations have a specific character. They often involve a real power imbalance — a president or gestoría with considerable authority over residents who may not fully understand their rights under Spanish law.

They also frequently involve language and cultural barriers that make direct communication difficult, particularly for British and international residents navigating a Spanish legal and administrative framework.

I understand both sides of this. I work across English and Spanish, and I have direct clinical and personal experience of how these disputes develop and what is needed to resolve them.

This is not generic mediation applied to a Spanish context. It is mediation informed by the realities of community life on the Costa del Sol.

How it works

Three stages

1The MIAM A confidential individual meeting with each party separately, to understand the dispute and confirm whether mediation is the right route.
2Joint sessions Online or in person in the Málaga area. Where the parties don't share a language, I work across English and Spanish within the same session.
3Or shuttle Parties stay in separate rooms and I move between them. Often better where feeling is running high, and common in community matters.

Accreditation status

Community mediation is currently offered as a WTA (Working Towards Accreditation) mediator, under professional supervision.

Languages and location

English, Spanish and Italian. Based in Málaga, working in person across the Costa del Sol and online anywhere.

Questions people actually ask

Before you book

Can mediation work if the other party won't engage? Book the MIAM anyway. Part of my job is approaching the other party and explaining the process. People who refuse at first often agree once they understand what it involves and what the alternative costs.
We don't share a language. Does that work? Yes. I work across English and Spanish within the same session, so nobody has to rely on a relative or a neighbour to interpret for them.
Is this instead of a lawyer? It sits alongside one. Mediation reaches an agreement; your abogado advises you on it and can formalise it. Many disputes never need the formal route once an agreement exists.
Does an agreement bind the community? What we agree is a written record, not a court order. How it gets adopted depends on your community's rules and the Ley de Propiedad Horizontal — your abogado or gestoría handles that step.
Can the community pay rather than individuals? Often yes, where the community has resolved to mediate. Say so when you get in touch and I'll quote it that way.
Do you travel? In person across the Málaga area and the Costa del Sol. Further afield, online, which for community matters works better than people expect.
